if someone wants to rollover their 401k into a <a href="http://selfdirectedirastore.com/roth-ira" class="kblinker" title="More about roth ira &raquo;">roth ira</a> their pretaxed 401k money will have to be turned into after taxed money durring the rollover to the roth ira. Is this money going to be taxed at the normal income tax rate for the individual so if you are in a 15% tax bracket would it be taxed at 15%. Or is it going to be claimed as ordinary income at the end of the year and taxed accordingly, in which case would be 50,000 salary plus 120,000 rollover would equal a taxable income of 170,000 which would equal a 35% tax bracket.</p>
<p>The money needs to be put in a roth ira because the preffered tax deffered <a href="http://selfdirectedirastore.com/2010/02/retirement/" class="kblinker" title="More about retirement &raquo;">retirement</a> vehicle is a matching 401k so a traditional ira is not a option as the 401k will be kept to receive the employer contribution</p>

In the event that the individual decides to change employers, there are four options available to the investor, all of which are outlined below:<br />
The employee can leave his or her assets in the 401k retirement plan of the previous employer<br />
Most 401k plan administrators will charge the investor various fees for record keeping and other services that have to do with managing the account, whether or not the investor is still with the company.<br />
These fees can take up a huge portion of your net worth, particularly if you maintain several accounts with different employers.<br />
The employee can apply for a <a href="http://selfdirectedirastore.com/401k-rollover/" class="kblinker" title="More about 401k Rollover &raquo;">401k rollover</a> to the 401k plan of the new employer.<br />
This option is generally available only if the employee gets another job offer before he or she leaves their current employer.<br />
This is the simplest option in most cases, and it may be the best alternative available to an employee. Knowing if this is the right choice should be a decision that is made based on the investment options available with the new 401k plan.<br />
If you feel that the choices that are available to you are unacceptable, you may find that a 401k rollover to an IRA may be a far better alternative.<br />
The employee can Complete a 401k rollover and transfer the assets into an <a href="http://selfdirectedirastore.com/individual-retirement-account/" class="kblinker" title="More about individual retirement account &raquo;">Individual Retirement Account</a> or IRA.In the majority of cases, completing a 401k rollover is the best choice for an employee who is interested in saving up for a comfortable retirement, since it allows the his or her capital to continue increasing tax-deferred, while still offering the advantage of giving as much control as possible over the allocation of assets.<br />
This means that the employee will not be limited to the range of investments that are offered by the 401k plan provider. How it works is that the distribution of the current 401k plan assets is first ordered and reported on Form 1099-R of the IRS.<br />
After the assets are received by the employee, they will then have to be contributed into the new retirement plan within sixty days, and this transaction is reported on Form 5498 of the IRS. Keep in mind that the government imposes a limit on 401k rollovers to once every twelve months.<br />
An employee can cash out the proceeds and pay taxes as well as the 10% penalty.<br />
This is by far the worse option that an employee can take, aside from not taking advantage of the contribution match program of an employer.<br />
Unfortunately, as many as 66 percent of 30 to 39 year old employee who change jobs opt to take cash when leaving an employer, and as many as 78 percent of those in the 20-29 age group do so as well. This is unfortunate especially when you consider the loss of decades worth of tax-deferred compounding that the capital will earn with a 401k rollover. <br/><br/></p>

After all for many people this is the largest check they will ever get from their employer and they want to make sure they get it right. However there are many advantages that an IRA offers you that your 401k doesn&#8217;t. Let&#8217;s examine the 5 reasons you might want to move your 401k to an IRA as soon as possible. <br/><br/>Are you familiar with the Stretch IRA? We don&#8217;t have the room to explain it in this article but it is one of the greatest gifts the IRS has ever given those of us who have IRA plans. It basically allows you to leave your IRA to your children or grandchildren and allow them to continue the tax deferral of your IRA over their lifetime. (certain restrictions apply) What does this have to do with your 401k? Many 401k plans do not allow for this option and will force your beneficiaries to cash out your plan much sooner than they would like if they are trying to postpone taxes. Won&#8217;t they have to pay tax eventually anyway? Sure but with the Stretch they can delay the tax so long that the compound tax-deferred interest will be so great that the IRS will never catch up. If this was the only consideration most people would do the rollover based on this alone but there are many other things to consider. <br/><br/>Another reason rolling the 401k over to an IRA makes since has a lot to do with the first reason. One reason the Stretch does not work well in a 401k is that your plan usually requires that you name a spouse as a beneficiary. Most of the time you and your spouse have about the same life expectancy and so this does not help you defer taxes much longer but it also presents another problem. The other problem is that when doing proper Estate Planning it is often a smart move to name children directly on certain assets to take full advantage of the Estate Planning rules. Doing so will often double how much money a couple can leave to their heirs without having their assets subjected to the dreaded estate taxes. Funds tied up in a company 401k plan do not allow you to name children or grandchildren without a signed waiver from your spouse. This can cause many problems as we get older as having someone sign a consent can become more difficult due to diminished capacity or other concerns. Even if you think this does not apply to you there are still many more reasons to consider rolling over your 401k to an IRA. <br/><br/>Having choices as to where to invest your money is particularly important in these economicly volatile times. When you leave your money in a 401k you can only invest in the options that they give you but if you roll your money over to an IRA the entire investment universe is yours. You can fund an IRA with any mutual fund, or bank CD, or insurance company annuity, or almost whatever you choose. You can even fund an IRA with real estate or gold coins if you want to. But if you leave it in your 401k you can only invest where they let you invest. I don&#8217;t know about you but I don&#8217;t like people telling me what I can and can&#8217;t do with my money. And your company may have great fund choices today but management may decide to go in a different direction tomorrow. I know of one of my clients whose boss changed 401k administrators 3 times during her employment. Each time she was given a new set of mutual funds to choose from. What if you don&#8217;t like the choices? What if management does a lousy job of picking your options? You&#8217;re stuck. <br/><br/>Here is another control issue for you. With an IRA you have no withdrawal restrictions. You are in complete control and you don&#8217;t have to ask permission to get at your own money. However in a 401k plan they may not let you have your money early even it is for something as serious as a personal hardship and you are not yet 59 1/2. And even if they do allow you access getting your hands on that money may take some time. Now if you need cash right away this could put added pressure on you that you just don&#8217;t need. <br/><br/>Last but not least IRA&#8217;s generally come with more help. Think about it, when you ask for advice on your 401k who do you have to call? Isn&#8217;t it usually your human resources department? Are you used to these folks going the extra mile to give you great advice and careful attention? Or do you sometimes gat a less than enthusiastic clerck that really has no interest in your financial success? When you roll over your 401k to an IRA depending where you place it you can often gain access to an advisor who works for you, not your company, and they will often help you customize not only your IRA but your entire <a href="http://selfdirectedirastore.com/2010/02/retirement/" class="kblinker" title="More about retirement &raquo;">retirement</a> plan. <br/><br/>If keeping more control over how you invest or when you can access your money is important to you than you will probably want to roll your 401k over to an IRA as soon as you are eligible to do so. Also if you think you may want to do some tax planning to help you stretch out your tax burden over multiple generations and allow your money to grow to it&#8217;s maximum potential and avoid estate tax if applicable than you may also want to roll over your 401k to an IRA as soon as you get the chance. <br/><br/></p>

			<content:encoded><![CDATA[<p>Transferring your 401k to an IRA is a very simple process, but not one you can do at any time, and there are a few things you&#8217;ll want to make sure get handled correctly to avoid losing a chunk of your savings unnecessarily. <br/><br/>  <br/><br/>You can only transfer your <a href="http://selfdirectedirastore.com/2010/02/retirement/" class="kblinker" title="More about retirement &raquo;">retirement</a> savings to a 401k immediately (typically within 30 days) after leaving a job. The rollover itself will take a bit of time so it&#8217;s good to get started on this right away. The first thing you want to do is find a company that you want to take care of your new IRA (independent retirement account). Many financial companies you&#8217;re probably already familiar with can handle this for you. <br/><br/>  <br/><br/>Once you&#8217;ve found a company and set things up with them to start your independent retirement account, contact the holders of your 401k account and inform them of what you&#8217;re going to be doing and where your new account is. Make sure that they send the check directly to your new account and not to you. Technically you can take the check and deliver it to the new account yourself, but this can easily end up looking like you cashed it. When you cash out money from your 401k before reaching retirement age you are charged state and federal taxes, on top of a ten percent early withdrawal penalty. This is something you definitely want to avoid. <br/><br/>  <br/><br/>While an independent account can be very different&#8211;because you&#8217;ll have more control over your investments, more options, and different contribution limit&#8211;you&#8217;ll soon find having an independent retirement account is a lot like your previous account and adapt to the changes fairly quickly. Rolling your 401k to an IRA is, overall, a pretty simple process as long as you pay attention to a few key details. <br/><br/>  <br/><br/></p>

			<content:encoded><![CDATA[<p>A reader recently asked if his 401(k) could be rolled over, by his beneficiary, to a &#8216;stretch&#8217; IRA after his death. Read on to discover an answer that will protect your beneficiaries from tens of thousands of dollars in unnecessary taxes and keep your gift to them alive for generations to come.<br />
Whether or not your beneficiary can rollover your 401(k) at your death (and subsequently stretch it) depends on who your beneficiary is and the terms associated with your company plan. Basically, you usually can&#8217;t stretch a 401(k) account directly, but if that money is rolled into an IRA, you can. This is a situation where the details matter.<br />
Let&#8217;s assume for the sake of illustration that you have a wife and 3 children. If your spouse is the beneficiary, she can roll the money from your 401(k) to her own IRA. Assuming that she has named the 3 children as beneficiaries of her IRA, they would have the ability to stretch it at her death. (&#8216;Stretching&#8217; an IRA refers to the ability for a beneficiary to take distributions based on their life expectancy instead of all at once.)<br />
Ideally, she would divide the money into 3 IRAs and name one child as the beneficiary for each one. That allows each child to stretch the IRA over their life expectancy. If the 3 children are the beneficiaries of 1 IRA then it would be stretched based on the oldest beneficiary&#8217;s life expectancy.<br />
On the other hand, if your children are the beneficiaries of your 401(k) plan they may or may not be able to stretch it. Let me explain. The tax laws allow for beneficiaries to stretch out distributions, but most company <a href="http://selfdirectedirastore.com/2010/02/retirement/" class="kblinker" title="More about retirement &raquo;">retirement</a> plans do not permit it. The reason is simple&#8211;the stretch can take place over decades.<br />
If the company allowed that, then they would be responsible for all the administration. There isn&#8217;t any benefit to the company to do so while it exposes them to potential liability. Instead, most company plans will cash out the beneficiaries at the death of the employee. At best, the beneficiaries may be able to stretch it out over 5 years.<br />
Realize what this means. Let&#8217;s say you have $600,000 in your 401(k). If your wife is the beneficiary, she can roll it to her own IRA and then when she dies, the children can stretch it. If a child is in their 50&#8242;s, that means that taxes can continue to be deferred (except for the annual required distribution) for almost 30 years. $200,000 can literally grow to millions of dollars over 30 years.<br />
If those children were the beneficiaries of your 401(k) instead and were cashed out at your death, they would not have the ability to roll that money to an IRA. They would have to pay taxes on all of that money in the year it was distributed. In our example, each of your three children would have to claim $200,000 in ordinary income that year! This would bump each child&#8217;s tax bracket and could result in 35% of it being lost in taxes. That&#8217;s a tax bill of $70,000 each, or a total of $210,000 in taxes on your $600,000 nest egg.<br />
Even if you have your wife as the primary beneficiary of your 401(k) and your children as the contingent beneficiaries, you are opening up the possibility of the children not being able to stretch distributions. If your wife passes away before you, or you both die in an accident, the 401(k) money would go to the children and most likely be distributed immediately.<br />
There really aren&#8217;t any benefits to keeping your retirement money in a 401(k) after you retire, but several big disadvantages. All of this is easily avoided by simply rolling that money to your own IRA. Your investment options will be much greater, and so will your flexibility and control. <br/><br/></p>

He has invested in the merrill lynch <a href="http://selfdirectedirastore.com/2010/02/retirement/" class="kblinker" title="More about retirement &raquo;">retirement</a> preservation trust fund. he has been told he cannot roll this fund over because of a bankruptcy.  But he was able to roll over other funds that were ML related&#8230;Why would this fund be part of a court ordered hold? And why would he not be told upfront when this happened rather than when he was trying to roll it over?<br />
BTW   my friend was just told that he could not roll this fund over because of a court order on the ML fund due to a bankruptcy&#8230;evidently this fund is tied to a huge bankruptly proceeding involving a company that is about to default&#8230;&#8230;Why would a judge hold this fund to where investors could not mover their investment out of it or notify the investors of this issue?</p>

<p>The last recession came like a thief in the night.  Those napping awoke and found they lost a majority of it.  Many began calling it their 41k.  </p>
<p>Donât think that the Wall Street types are going to take pity on you just because you donât care about whatâs going on.  These guys are great at telling you to buy and hold while they are moving their money around trying to catch the latest greatest deal.  Itâs ironic that youâre limited to moving the funds around in your 401k because the fundâs managers were caught moving theirs around EVERY day.  Most of the people I talk to donât even know HOW to move the funds around in their 401k!</p>
<p>I know itâs hard to know exactly what to do.  Itâs not a perfect world.  We donât even know if weâre actually IN a recession or not.  In fact the government types that officially determine when recessions start and end canât agree. In the last four recessions, it took them on average 8 months to let us know it started.  Many recessions donât even LAST 8 months!  They are even worse letting us know when theyâre done.  On average, it took them almost 2 years to let us know the recession was over.  If THEY donât know, how are WE supposed to?</p>
<p>Think that the company running your 401k cares about you?  When was the last time someone from there called you and said you should re-think the way your 401k is invested?  When was the last time ANY financial type called you and said ANYTHING about your 401k?  Maybe theyâre too busy paying attention to their own.  Itâs probably the largest single investment you own.  Itâs also probably the single most ignored thing you own.  I saw people who went into the last recession with $100,000 and came out with $30,000.  I wonder how long it took them to earn the $70,000 they just gave away; a heck of a price to pay for not caring.  </p>
<p>Donât let them put your hard earned, perfect 401k onto the alter of Recession.  Instead, sacrifice a little of your time and pay attention to your 401k, it will keep it from becoming THE Suckers Perfect Sacrifice. <br/><br/></p>
